Our Bankruptcy, Reorganization and Creditors’ Rights lawyers represent debtors, creditors and other stakeholders and interested parties in all aspects of bankruptcy, restructuring and financial insolvency issues.
Because these matters feature complex issues and multiple constituencies, often with opposing interests, clients require time-critical, personalized advice and recommendations from seasoned attorneys with knowledge of the business, financial and legal issues impacting outcomes. We offer dynamic and pragmatic counseling and a full range of capabilities to obtain results in a practical, cost-effective manner, advocating for clients as an assertive voice of reason to bring disputes to resolution.
Walsh attorneys represent clients in a wide range of business restructurings, out-of-court workouts, liquidations, litigation, transactions and other situations involving distressed entities. Walsh represents all constituencies in restructuring and insolvency matters, including debtors, secured and unsecured creditors, lessors, creditors’ committees, purchasers and sellers of distressed assets, shareholders and other equity interest holders, trustees, board members and litigants.
Among other areas, our team has significant experience representing debtors and trustees in healthcare insolvencies including, most recently, in the chapter 11 bankruptcies of a $39 million senior and assisted living facility located in northern California; a Federally Qualified Health Center in New Jersey; and a nationwide chain of outpatient surgery centers based in Philadelphia, Pennsylvania. Walsh attorneys also represented Bayonne Medical Center and the liquidating trustee throughout its bankruptcy proceeding and in connection with subsequent litigation.
Our attorneys possess a broad range of transactional and litigation experience in bankruptcy and restructuring matters, enabling them to deliver what matters most to our clients. Walsh’s transactional work includes experience representing lenders and domestic and foreign corporations in distressed and troubled situations in a wide variety of industries, from technology and pharmaceuticals to manufacturing, healthcare and retail.
When protecting creditors’ rights, preserving investment value, recovering debt and collecting on claims is critical. Our attorneys guide creditors through complex bankruptcies, out-of-court restructurings and workouts to help maximize their recoveries. In addition, our attorneys have the broad interdisciplinary knowledge needed to provide secured and unsecured creditors, official and ad hoc committees of creditors and equity holders, and asset purchasers with experienced counsel in matters concerning troubled companies with complex debt and equity issues.
When litigation is necessary, our dedicated team regularly represents clients in connection with bankruptcy litigation, contested matters and related disputes in state and federal court. These include contested Chapter 11 plan confirmations and sale motions, prosecution and defense of fraudulent transfer and preference claims, representing directors and officers following bankruptcy, commercial loan workouts, foreclosure and debt-instrument litigation, tax sale foreclosures, judgment enforcement, collateral recovery and other insolvency-related matters.
Walsh attorneys routinely collaborate among our firm’s practice groups to provide clients with access to a broad range of experience in other specialized areas in an inter-disciplinary approach to achieve complete guidance and solutions to our clients’ restructuring and insolvency needs.
